DISCLOSURE AND ACKNOWLEDGMENT
I/We, ________________, hereby acknowledge that AARON POSNIK & COMPANY, of Springfield, Massachusetts on behalf of Philip R. Coleman and Robin E. Fleet, has offered to supply me/us with a copy of an appraisal of a certain piece of real estate located at 35 Cliffwood Street, Lenox, Massachusetts completed by Diane McKinney and John Weaver of Berkshire Appraisal Associates dated February 5, 2003 ("Appraisal"). I/We acknowledge and agree that such Appraisal will be given to me/us for informational purposes only and is not intended to be a document upon which I/we should rely in participating in the Absolute Auction of 35 Cliffwood Street.
I/We hereby indemnify and hold PHILIP R. COLEMAN, ROBIN E. Fleet and AARON POSNIK & COMPANY ("Indemnified Parties") harmless from and against any all claims, demands, fines, suits, actions, decrees, proceedings, orders, judgments, damage or liability (including attorneys' fees incurred by the Indemnified Parties with respect thereto) as of any kind or nature, resulting from or arising from in whole or in part, from my/our use or reliance upon the matters contained in the Appraisal.
