By virtue and in execution of the POWER OF SALE contained in a certain mortgage given by DELANEY HOUSE, LLP with an address of 1 Country Club Road, Holyoke, Hampden County, Massachusetts to Springfield Institution for Savings, n/k/a Banknorth, N.A., dated March 28, 1996 recorded with the Hampden County Registry of Deeds, Book 9431, Page 93; as amended by Amendment to and Spreader of Mortgage and Security Agreement dated January 17, 2001 recorded in said Registry of Deeds at Book 11477, Page 140, as further amended by Amendment to Mortgage and Security Agreement and Collateral Assignment of Leases and Rentals dated October 19, 2001 and recorded in Book 11925, Page 396 and as further amended and affected by Amended, Restated and Consolidated Mortgage and Security Agreement between Delaney House, LLP and Banknorth, N.A. dated August 2, 2002 and recorded in Book 11491, Page 275 (hereinafter collectively referred to as the "Mortgage"), of which Mortgage the undersigned is the present holder, for breach of the conditions of said Mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 1:00 P.M. on the 24th day of April, 2003, upon the mortgaged premises at 1 Country Club Road, Holyoke, Hampden County, Massachusetts, all and singular the premises described in said Mortgage.
